Terms of Service

These Terms govern use of xbrag.lol: the public board, the donation flow and everything around them. By using the site, creating a listing or making a donation through the site you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the site and do not donate.

Before you are sent to donate you must tick a box confirming you have read and agree to these Terms.

These Terms work with the public Rules. Where the two conflict, these Terms control.

Operator and contact

The site is operated by Rajan Lakhani, an individual in Hermosa Beach, California, United States ("we", "us", "our").

What this is

xbrag is a public ranking of X accounts, ordered by the amount donated to charity in connection with each listing. You may make a donation to one of the charities listed on the site and, having done so, list an X account and hold a rank based on the amount donated, as described in the Rules. Listings are placements. They are not reviews, certifications, endorsements or independent rankings, and a listing is not our opinion of anyone.

A donation results in a position on the board at the rank that amount can take at the moment the donation is confirmed to us. It does not buy traffic, clicks, followers, customers, exclusive placement, a fixed duration at a rank, search ranking, or any particular outcome. Somebody else can donate more and outrank you. We may change, pause or discontinue any feature.

Donations, and who receives them

We do not receive your donation, and we take no part of it. When you donate through this site you are sent to every.org (Every.org, a registered 501(c)(3) public charity), who process the payment and are the recipient of the funds. Every.org grants the funds on to the charity you selected in accordance with their own terms and grant-making policies. Your contract for the donation is with every.org, not with us.

We receive no fee, commission, percentage, revenue share or other compensation in connection with your donation. Not from you, not from every.org, not from any charity. Our cut is zero. We are not a professional fundraiser, fundraising counsel, commercial fundraiser, commercial co-venturer or charitable-sales promoter, and we do not solicit, receive, hold or control charitable funds.

Your tax receipt comes from every.org, in the name of the charity, at the email address you give them. We do not issue receipts, cannot reissue theirs, and give no tax advice. Whether your donation is deductible is between you, every.org and your own adviser.

The charities named on this site are not affiliated with us and have not endorsed, sponsored or approved this site or any listing on it. We are not their agent and do not act on their behalf. Their names are used only to identify which organisation a donation was made to.

Every.org's payment processor deducts a processing fee from the donation before it reaches the charity. That fee is the processor's, not ours. Amounts shown on the board are the amount donated, before that fee.

Eligibility

You must be at least 18 and able to enter a binding contract. If you use the site for a company, you confirm you have authority to bind it, and "you" includes that company. You may not use the site if sanctions or other applicable law prohibit it.

Payments

The donation is taken by every.org and their payment processor. We never see, receive or store your card details or your donation, and every.org's own terms and privacy notice apply to the payment itself. Amounts are in US dollars.

Minimums, increments and how repeat donations accumulate are described in the Rules and shown before you are sent to donate. Rank is assigned when every.org confirms the donation to us and the row is written to the board. Donations above a threshold we set are confirmed by hand before they rank; this does not affect the donation itself, which is complete either way.

If the site ever charges you a fee of its own, it will be shown separately, described as a fee to xbrag, and taken through Stripe as a transaction distinct from any donation. No such fee is charged at present. Any voluntary tip to the operator, offered in the site footer, is not a donation, is not charitable, is not tax-deductible, and forms no part of any amount shown on the board.

Refunds

We cannot refund a donation, because we never receive it. Your money goes to every.org and on to the charity. Any request to reverse a donation is a matter for every.org under their policies, and a completed charitable gift is generally irreversible.

Placement on the board begins the moment a donation is confirmed: the row is created or raised and the amount is shown publicly. Being outranked later, receiving fewer clicks than you hoped, downtime, or a removal under these Terms does not create any right to a refund from us, and does not undo the donation.

By donating you ask us to place the listing immediately. Some places give you a statutory cancellation or cooling-off right, the United Kingdom and the European Union among them. If you are in one of them, you accept that you lose that right in respect of the placement, to the extent the law permits the waiver. Where a mandatory consumer right cannot be waived, we honour it.

Chargebacks or payment disputes raised against a donation are a matter between you, every.org and your card issuer. Raising one without a legally required basis is a breach of these Terms, and we may remove the listing and refuse you future use of the site.

Your warranties

By submitting a handle or a payment you represent and warrant that:

• You own the X account you are listing, or you are authorised to represent it.
• The donation is yours to make, made with your own funds or funds you are authorised to use, and you are not donating in someone else's name to place them on the board without their authorisation.
• You are not impersonating another person, brand or company, and you are not claiming a rank for a competitor's or anyone else's account without their authorisation.
• The line you write is accurate, is not defamatory, misleading, harassing or unlawful, and does not infringe anyone's rights.
• The listing complies with all applicable law, including advertising, consumer, privacy and intellectual-property rules.
• The account is not used for malware, phishing, a scam, or to deceive people.

Our right to remove a listing

We may refuse, delay, edit, hide or permanently remove any listing, with or without notice, including where we believe these Terms, the Rules or the law may have been broken; where the person or brand named complains; where a rights holder or platform complains; or where a listing creates legal, security or reputational risk. Removal does not entitle you to a refund, and cannot: the donation was made to a charity and is not ours to return.

Takedown and rights notices

If you are on this board and did not put yourself there, tell us and the listing comes down. We do not ask you to prove you own the account beyond the account itself.

If you believe a listing infringes your rights, impersonates you, or is unlawful, send us: (1) your name and contact details; (2) the handle as it appears on the board; (3) what the problem is; and (4) a statement that your notice is accurate and that you are the person named, the rights holder, or authorised to act for them.

We may remove or hide the listing while we review a notice. We may pass the notice to the person who paid for the listing. Repeated or abusive notices may be ignored.

Names, avatars and fair use

To run the board we show publicly available information about a listed account: the handle and the profile picture X serves publicly. We use it only to identify which account a paid placement points at.

We do not use anyone's name or picture as our own brand, and we do not suggest sponsorship or endorsement by the account holder. This is intended as nominative fair use under United States trademark law: we use only what is needed to identify the account, and nothing more. Where other law applies, third-party names and signs are used solely to identify the account being listed, which is not affiliation or endorsement.

xbrag, our wordmark and the look of the site are ours. You may not copy the site or scrape the board to build a competing ranking.

Licence you grant us

You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, reproduce, resize and publicly display your listing and the public profile information we fetch, for as long as we need it to run and archive the site. If you want a listing taken down, tell us. A takedown does not undo a completed payment.

No endorsement, no earnings claims

Appearing on the board is not our opinion of anyone. We do not verify claims made in a listing, and we do not verify that the account named made the donation. Click and visitor counts describe what our systems recorded; they are not a promise that you will get the same. Amounts raised describe donations every.org has confirmed to us. Links leave xbrag and we are not responsible for what is at the other end.

Availability

The site is provided as-is. It may be unavailable, slow or wrong. We may change ranking rules, minimums or these Terms; if a change is material we will update the date at the top. For a payment already completed, the Terms in effect at checkout apply to it.

Disclaimers and liability

To the fullest extent the law allows we disclaim all warranties, express or implied. We do not warrant that the site will be uninterrupted or error-free, or that ranks, names, images or click counts are accurate.

We do not exclude liability that cannot lawfully be excluded, including for fraud, or for death or personal injury caused by negligence. Subject to that, we are not liable for lost profits, lost data, lost goodwill or any indirect, incidental, special or consequential loss, and our total liability for any claim relating to a listing or a donation is limited to the greater of the fees you have paid to us (which, for a donation, is nothing) and US$50. Some states do not allow the exclusion of certain damages, so parts of this may not apply to you.

Indemnity

You will indemnify and hold us harmless from claims, damages, losses and reasonable legal costs arising out of your listing, the account you listed, the line you wrote, your donation or chargeback, your breach of these Terms, or your infringement of anyone's rights.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. The state and federal courts located in Los Angeles County, California have exclusive jurisdiction, and you consent to venue there. Where the mandatory consumer law of your own country or state gives you rights that cannot be waived, those rights still protect you.

General

If part of these Terms is unenforceable the rest stands. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them if the site changes hands. These Terms, the Rules, the Privacy Policy and what you confirm at checkout are the whole agreement.
