Terms of Service

These Terms govern use of xbrag.lol — the public board, checkout and everything around them. By using the site, creating a listing or completing a payment you agree to these Terms and to the Privacy Policy. If you do not agree, do not use the site and do not pay for a rank.

Before checkout you must tick a box confirming you have read and agree to these Terms.

These Terms work with the public Rules. Where the two conflict, these Terms control.

Operator and contact

The site is operated by Rajan Lakhani, an individual in the United Kingdom ("we", "us", "our").

What this is

xbrag is a paid public ranking of X accounts. You may pay to list an X account and to hold a rank based on the amount paid, as described in the Rules. Listings are paid placements. They are not reviews, certifications, endorsements or independent rankings, and a listing is not our opinion of anyone.

A payment buys a position on the board at the rank that amount can take at the moment it is fulfilled. It does not buy traffic, clicks, followers, customers, exclusive placement, a fixed duration at a rank, search ranking, or any particular outcome. Somebody else can pay more and outrank you. We may change, pause or discontinue any feature.

Eligibility

You must be at least 18 and able to enter a binding contract. If you use the site for a company, you confirm you have authority to bind it, and "you" includes that company. You may not use the site if sanctions or other applicable law prohibit it.

Payments

Checkout is processed by Stripe. We never see or store full card numbers; Stripe's own terms and privacy notice apply to the payment itself. Amounts are in US dollars and applicable taxes may be added at checkout.

Minimums, increments and the raise-only-the-difference charge are described in the Rules and shown before you pay. Completing checkout is an offer to buy placement on those terms. Rank is assigned when the payment confirms and the row is written to the board.

No refunds

All payments are final and not refundable. Placement is a digital service that begins the moment payment confirms: the row is created or raised and the amount is shown publicly. Being outranked later, receiving fewer clicks than you hoped, downtime, or a removal under these Terms does not create a refund.

By completing checkout you ask us to begin that service immediately and accept that you lose any statutory cancellation or cooling-off right to the extent the law permits that waiver. Where a mandatory consumer right cannot be waived, we honour it.

Chargebacks or payment disputes raised without a legally required basis are a breach of these Terms. We may remove the listing and refuse you future use of the site.

Your warranties

By submitting a handle or a payment you represent and warrant that:

• You own the X account you are listing, or you are authorised to represent it.
• You are not impersonating another person, brand or company, and you are not claiming a rank for a competitor's or anyone else's account without their authorisation.
• The line you write is accurate, is not defamatory, misleading, harassing or unlawful, and does not infringe anyone's rights.
• The listing complies with all applicable law, including advertising, consumer, privacy and intellectual-property rules.
• The account is not used for malware, phishing, a scam, or to deceive people.

Our right to remove a listing

We may refuse, delay, edit, hide or permanently remove any listing, with or without notice, including where we believe these Terms, the Rules or the law may have been broken; where the person or brand named complains; where a rights holder or platform complains; or where a listing creates legal, security or reputational risk. Removal does not entitle you to a refund.

Takedown and rights notices

If you are on this board and did not put yourself there, tell us and the listing comes down. We do not ask you to prove you own the account beyond the account itself.

If you believe a listing infringes your rights, impersonates you, or is unlawful, send us: (1) your name and contact details; (2) the handle as it appears on the board; (3) what the problem is; and (4) a statement that your notice is accurate and that you are the person named, the rights holder, or authorised to act for them.

We may remove or hide the listing while we review a notice. We may pass the notice to the person who paid for the listing. Repeated or abusive notices may be ignored.

Names, avatars and fair use

To run the board we show publicly available information about a listed account: the handle and the profile picture X serves publicly. We use it only to identify which account a paid placement points at.

We do not use anyone's name or picture as our own brand, and we do not suggest sponsorship or endorsement by the account holder. Where United States law applies this is intended as nominative fair use. Where United Kingdom or European law applies, third-party names and signs are used solely to identify the account being listed, which is not affiliation or endorsement.

xbrag, our wordmark and the look of the site are ours. You may not copy the site or scrape the board to build a competing ranking.

Licence you grant us

You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, reproduce, resize and publicly display your listing and the public profile information we fetch, for as long as we need it to run and archive the site. If you want a listing taken down, tell us. A takedown does not undo a completed payment.

No endorsement, no earnings claims

Appearing on the board is not our opinion of anyone. We do not verify claims made in a listing. Click and visitor counts describe what our systems recorded; they are not a promise that you will get the same. Links leave xbrag and we are not responsible for what is at the other end.

Availability

The site is provided as-is. It may be unavailable, slow or wrong. We may change ranking rules, minimums or these Terms; if a change is material we will update the date at the top. For a payment already completed, the Terms in effect at checkout apply to it.

Disclaimers and liability

To the fullest extent the law allows we disclaim all warranties, express or implied. We do not warrant that the site will be uninterrupted or error-free, or that ranks, names, images or click counts are accurate.

We do not exclude liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for lost profits, lost data, lost goodwill or any indirect or consequential loss, and our total liability for any claim about a payment is limited to the amount you paid for the listing that claim concerns.

Indemnity

You will indemnify and hold us harmless from claims, damages, losses and reasonable legal costs arising out of your listing, the account you listed, the line you wrote, your payment or chargeback, your breach of these Terms, or your infringement of anyone's rights.

Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer with mandatory local protections that cannot be displaced, those still protect you.

General

If part of these Terms is unenforceable the rest stands. Our failure to enforce a term is not a waiver. You may not assign these Terms without our consent; we may assign them if the site changes hands. These Terms, the Rules, the Privacy Policy and what you confirm at checkout are the whole agreement.
